Consumer Product Safety Improvement Act

In August 2008, the federal Consumer Product Safety Improvement Act (the “Act”) became effective. An important requirement of the Act was to limit the levels of total lead in products intended for use by children 12 years of age or younger. In addition, under the Act, by February 10, 2009, manufacturers and importers of children’s products were required to make available a “conformity certification,” based on a test of each product or a reasonable testing program, to demonstrate that their products complied with the stated lead limits.

On January 29, 2009, the Consumer Product Safety Commission (the “CPSC”) issued a “stay” (i.e., extended) the conformity certification and testing requirement deadline for one year. Specifically, with certain exceptions (not applicable to our products), this means that the conformity certification and testing requirements are stayed until February 10, 2010. In part, the CPSC extended the deadline because it intends to clarify the certification and testing requirements during 2009. In addition, the CPSC will be evaluating whether certain products should be exempt from the certification and testing requirements because they simply would not be expected to contain lead.

The extension does not affect the requirement to ensure that children’s products contain less than 600 parts per million (“ppm”) lead beginning on February 10, 2009, and less than 300 ppm lead beginning on August 14, 2009. We have no reason to believe that lead is contained in our fabrics. Nevertheless, in furtherance of the Act’s purposes, we recently had a representative sample of our fabrics tested in a third party certified laboratory. We are pleased to say that in each case, the analytical results indicate that our representative fabrics comply with the Act’s total lead limits. In fact, the laboratory testing did not detect any lead in the fabrics to a level of 10 ppm, which essentially indicates that they are lead free.

We are committed to providing our customers with the highest quality products that are safe for their intended purpose, and we will continue to do so. We will also continue to monitor future developments under the Act. As any requirements are clarified which relate to the products we provide to you, we will share that information with you.
